General Terms and Conditions
1. About hospitalityInside.com
hospitalityInside.com is a fee-based, interactive information service of HospitalityInside GmbH, Paul-Lincke-Strasse 20, 86199 Augsburg, Germany - hereinafter referred to as "HospitalityInside" - which provides online information to self-employed persons and representatives of companies - hereinafter referred to as "users" - for their business purposes. With his registration or order, the user assures an exclusively personal use and only for his own business or professional purposes. HospitalityInside publishes articles in several languages. It is at the discretion of the editorial team to decide in which language versions individual contributions are published.
2. Scope
Any Internet offer made by HospitalityInside is performed on the basis of the following General Terms and Conditions (GTC). These GTCs are recognised and bindingly agreed upon with the registration of the user. The GTCs available online at the time of their use shall apply in each case. The user may download texts to his computer and/or print them. These GTCs apply exclusively. Terms or conditions of the purchaser that conflict with or deviate from these GTCs will not be recognised unless they are confirmed in writing by HospitalityInside.
3. Registration, conclusion of contract, access authorisation, contract language
3.1 By registering or ordering an information service, the user accepts these GTCs. A contract between HospitalityInside and the user for the provision of the requested fee-based information service is only concluded upon written order confirmation by HospitalityInside or its vicarious agents. In the case of an online order, HospitalityInside or its vicarious agents shall immediately confirm receipt of the user's order by e-mail.
3.2 These General Terms and Conditions have been prepared in German and subsequently translated into English. In the event of a dispute between the parties regarding the interpretation of any of its provisions, the German version shall prevail.
3.3 After conclusion of the contract, the user receives access to the information service to the extent selected in the order by transmitting his user name and password. This access and usage authorisation is only valid for one user. The user undertakes not to disclose his user name and password to third parties.
4. Changes
HospitalityInside is entitled to change these GTCs at any time, even within an ongoing business relationship, by notifying the user with two weeks' notice. This notification may be made in a binding manner not only by transmitting the full text of the GTCs, but also by indicating and referring to the location of the full text of the GTCs on the Internet. If the user does not object to this change within two weeks after receipt of the change notification, this shall be deemed acceptance of the GTCs in the changed form.
5. Access to the hospitalityInside.com information service
5.1 HospitalityInside offers users paid online access to the latest information in the magazine via the Internet and, if agreed, additional services. These accesses take place within the framework of a subscription. The magazine pages are free of advertising.
5.2 The subscriptions grant time-limited access to current information as well as to certain databases and differ according to the agreed contractual service in terms of duration, access rights and prices.
5.3 The provision of the user's internet access as well as the maintenance of the online connection is exclusively the responsibility of the user. Internet connection fees are not included in the prices for this information service.
6. Other offers
6.1 Apart from the paid online magazine, hospitalityInside publishes selected articles from various sources, which are usually available free of charge.
6.2 HospitalityInside hosts or organises seminars, workshops, conferences and networking opportunities. If an event is aimed at a specific target group or if special prior knowledge is required for participation, we will make this clear in the corresponding announcement. 7. Obligation of respect and advertising ban
In the case of interactive or dialogue-oriented formats, the user undertakes to limit communication with other users to the professional exchange of opinions and to take into account the interests of the other participants.
8. Copyright
8.1 All contents published by HospitalityInside are copyright protected. Each use is subject to the valid copyright and protection laws.
8.2 Premium contents of HospitalityInside, i.e. those which the user can only view in full as a subscriber after login, are intended exclusively for the personal and other own use of the user.
The stored and/or printed premium content may not be reproduced except for the purposes of personal or other own use, and in particular may not be transferred to third parties, electronically or in any other way disseminated, publicly reproduced or further published. Any digital use of this content or in printed works is subject to the approval of HospitalityInside GmbH. Exceptions are quotations in the usual context with indication of the source.
Premium content is subject to a charge and is identified as such by an HI+ sign and/or by a corresponding note at the end of the article.
8.3 In the case of free content, i.e. content on hospitalityInside.com that is not protected by login, non-commercial further distribution, either of parts of the article or in full, is permitted provided that such content is distributed unchanged, that the source is always indicated as "hospitalityInside.com" and that these conditions are also marked as mandatory for further distribution. In case of doubt, permission must be obtained from HospitalityInside.
8.4 On preparation of copies, the contents may not be changed or falsified and HospitalityInside must be recognisable as source. The user may not remove copyright notices, trademarks and other legal reservations in the retrieved data.
8.5 Violations of the provisions of copyright law constitute criminal offences and will be vigorously pursued by us. In addition, we reserve the right to assert claims for damages.
9. Commercial further use by third parties
Any further distribution and utilisation of contents of HospitalityInside beyond the framework permitted by copyright is subject to charge. For the use of HospitalityInside content on websites or in printed works, licences can be purchased. For legal use of HospitalityInside content on websites, please refer to our content syndication program (link with shop/article licence).
10. Remuneration
10.1 The prices for subscriptions (link with shop/subscription) are based on the respective valid price list at the time of order. Payment shall be made without deduction and shall be due immediately upon conclusion of the contract.
10.2 HospitalityInside reserves the right to increase prices to the extent permitted by law. Price increases for existing subscriptions shall only become effective with the next main due date / extension.
11. Default
In the event of a default in payment by the user, the provisions of § 288 II BGB shall apply.
Unless otherwise agreed, default in payment shall commence 14 working days after the invoice has been sent. A separate reminder is not required for this.
HospitalityInside reserves the right to withdraw the affected access rights in the event of late payment. The right to extraordinary termination by HospitalityInside remains unaffected.
12. Warranty
12.1 HospitalityInside does not warrant the functionality of the portal software for the user.
12.2 HospitalityInside does not warrant that any particular results will be obtained from the use of the Information Service.
12.3 The warranty period is 12 months.
13. Liability
13.1 HospitalityInside shall be liable without limitation for deliberate acts and gross negligence. HospitalityInside is liable for simple negligence only and limited to the contract-typical foreseeable damage, provided that an obligation is violated which is of particular importance for the achievement of the purpose of the contract.
13.2 The above limitations of liability shall not apply to claims under the German Product Liability Act and to damages resulting from injury to life, body or health.
13.3 Data communication via the Internet cannot be guaranteed to be error-free and/or available at all times given the current state of technology. HospitalityInside is therefore not liable for the constant and uninterrupted availability of the online information service, nor for technical and electronic errors during transmission or other use over which HospitalityInside has no control, which includes, in particular, performance disruptions due to force majeure or disturbance of industrial peace. In such cases, there shall in particular be no claim to performance, damages or reduction of the subscription price.
13.4 However, HospitalityInside endeavours to provide access to the Online Offer 24 hours a day, 7 days a week. Temporary interruptions of service due to the usual maintenance times, system disturbances of the Internet at external providers or at external network operators as well as in case of force majeure are possible. HospitalityInside assumes no liability for this.
13.5 HospitalityInside shall only be liable for the loss of data in accordance with the above provisions if such loss could not have been avoided by reasonable data backup measures on the part of the user.
13.6 The above limitations of liability shall apply mutatis mutandis in favour of HospitalityInside's vicarious agents.
13.7 Insofar as the HospitalityInside website offers the possibility of forwarding to databases, websites, services, etc. of third parties, e.g. by creating links or hyperlinks, HospitalityInside is neither liable for the accessibility, existence or security of these databases, services, nor for the content thereof. In particular, HospitalityInside is not liable for their legality, accuracy of content, completeness and timeliness, etc..
13.8 We exercise the utmost care in the preparation of the offer under the website "www.hospitalityInside.com". All information and data have been prepared to the best of our knowledge, but we do not assume any liability for their completeness, correctness and scope. HospitalityInside GmbH has no influence on the current and future design and content of the linked external pages. The contents of the linked pages are the exclusive responsibility of the respective operator. For this reason, HospitalityInside GmbH hereby expressly distances itself from all content of all linked pages.
14 Data protection & Data security
14.1 HospitalityInside uses the personal data provided by the customer in accordance with the provisions of German data protection law.
14.2 Personal data of the user, insofar as these are necessary for the establishment, the content or the modification of the contractual relationship (inventory data), are used exclusively for the processing of contracts with the customers.
14.3 Personal data of the user, which are necessary to enable the use of the online offers of HospitalityInside and to bill the user (usage data), are used by us exclusively to process contracts with the user and to design the online offer according to the user's needs. Such usage data may also be used for advertising and market research purposes, provided that the user has consented to such use of the data.

15. Cancellation
15.1 Subscriptions (link to shop/subscription) can be cancelled at the earliest at the end of the agreed term. If an annual subscription is not cancelled six weeks before the contractual end of the term, it will always be automatically renewed for another year.
15.2 In the case of a monthly trial subscription, the contract shall end at the end of the trial month.
15.3 Any termination must be in writing to be effective and must be received by mail or e-mail (mail-to-link: office@hospitalityInside.com) HospitalityInside.
16. Termination for good cause
16.1 HospitalityInside is entitled to unilaterally terminate any user agreement with the user if the subscriber misuses or uses the access data in a manner contrary to the contractual provisions, in particular if the data is forwarded to third parties or if individual provisions of this agreement are violated in any other way.
16.2 HospitalityInside is further entitled to terminate the contractual relationship in the statutory cases without notice for good cause. Unless otherwise stipulated, such good cause shall be deemed to exist in particular if the user violates legal provisions or commits criminal acts while using HospitalityInside content or services, or if the user is in default with a due claim or other financial performance and does not pay within a period of 14 days despite prior reminder with threat of rejection.
16.3 The right of extraordinary termination for the user in accordance with the statutory provisions remains otherwise unaffected.
17. Prohibition of assignment and set-off
The user may not assign claims against HospitalityInside without HospitalityInside's prior written consent and may only offset such claims if they have been acknowledged in writing or confirmed by a court of law.
18. Place of jurisdiction, place of performance, applicable law
The place of jurisdiction and performance for all legal disputes is Augsburg. All legal relationships between the user and HospitalityInside shall be governed exclusively by the laws of the Federal Republic of Germany. HospitalityInside is optionally also entitled to bring an action before the court having jurisdiction over the user's place of business and residence.
19. Severability clause
Should individual provisions of these GTCs be or become invalid, the remaining provisions shall remain valid. The invalid provision shall then be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision. This shall also apply if these GTCs should prove to be incomplete or unenforceable.
